A legal disclaimer
The Hirer acknowledges that under Western Australian law, any spa or hot tub capable of holding more than 300mm of water must be enclosed by a compliant safety barrier in accordance with the Building Regulations 2012 (WA) and Australian Standard AS1926.
The Hirer accepts full legal responsibility for ensuring:
- The property meets all fencing and safety requirements
- A compliant barrier is installed before filling or using the hot tub
- Ongoing compliance during the entire hire period
Party Rock Tubs does NOT provide fencing, compliance certification, or council approval
services.
Party Rock Tubs accepts no responsibility for fines, penalties, enforcement action, injury,
death, or legal claims arising from non-compliance.
Customer Indemnity
The Hirer agrees to indemnify and hold harmless Party Rock Tubs from any:
- Legal claims
- Council fines
-Injury or fatality claims
- Loss or damages resulting from failure to comply with pool/spa safety laws, fencing requirements, or improper use.
Water Filling Responsibility & Activation of Spa
Party Rock Tubs will deliver, position, and connect the hot tub, and may perform a basic function check.
Party Rock Tubs will NOT fill the hot tub with water.
The Hirer is solely responsible for:
- Filling the hot tub
- Ensuring all fencing and legal safety requirements are fully compliant BEFORE filling
- Confirming the installation site is safe, lawful, and suitable prior to making the hot tub operational
By filling the hot tub, the Hirer acknowledges that:
- The site is legally compliant
- Required fencing is installed
- They accept full responsibility for legal compliance, safety, supervision, and use
Duty of Care Disclaimer
Party Rock Tubs supplies equipment only and provides general operating guidance but does not supervise use.
The Hirer accepts full responsibility for:
- Safe use of the hot tub• Adult supervision at all times
- Preventing access by children or pets
- Ensuring electrical and ground safety
- Compliance with all applicable laws
Right to Refuse or Remove Equipment
Party Rock Tubs reserves the right to:
- Refuse delivery
- Cancel hire
- Remove equipment immediately
If site conditions appear unsafe, unlawful, or non-compliant.
No refunds will be issued if cancellation is due to safety or legal non-compliance.
Customer Safety Obligations
The Hirer agrees to:
- Never allow unsupervised children near the hot tub
- Never move or tamper with electrical components
- Follow all safety and operating instructions provided
- Maintain safe water levels and hygiene
- Prevent overcrowding or unsafe behaviour
- Ensure no intoxicated or unsafe use
Damage, Loss, Misuse & Accessory Care
The Hirer is responsible for:
- Damage caused to the hot tub or accessories due to misuse or negligence
- Cleaning fees if the hot tub is returned excessively dirty
- Repair or replacement costs if equipment is damaged, lost, or stolen
Gazebo, Lighting & Accessory Damage
The Hirer accepts responsibility for the reasonable care of all additional hired items, including
hot tub gazebos, lighting, covers, steps, and accessories.
The Hirer will be liable for repair or replacement costs where damage occurs due to:
- Misuse, abuse, or negligence
- Climbing or hanging on gazebo frames
- Wind damage where securing instructions were not followed
- Water damage caused by improper handling of electrical lighting
- Unauthorized moving, tampering, or modification
Normal wear and tear are excluded from chargeable damage.
Party Rock Tubs may charge reasonable repair or replacement costs, supported by evidence
where required
- Maximum capped for full equipment write off damage limit: $900
Liability Limitation
To the maximum extent permitted by law, Party Rock Tubs is not liable for:• Personal injury or death
- Property damage
- Loss of enjoyment
- Indirect or consequential loss
Nothing in these terms limits rights under Australian Consumer Law.
Insurance Recommendation
The Hirer is strongly advised to ensure their home and public liability insurance covers
temporary spa installations.
Payment, Deposits & Cancellations
- Full payment due on delivery
- Security deposit may apply
- Cancellations within 48 hours are non-refundable
- Weather cancellations at Party Rock Tubs’ discretion
